Purpose
The purpose of this Telehealth Consent ("Consent") is to provide you with information about telehealth and to obtain your informed consent to the use of telehealth in the delivery of healthcare services to you by physicians, physician assistants, nurse practitioners, and other appropriately licensed healthcare professionals ("Providers") through the HealFastRx service ("Service").
HealFast, Inc., doing business as HealFastRx ("HealFastRx," "HealFast," "we," "us," or "our"), provides access to the Service and related technology through www.healfastrx.com and third-party technology providers.
HealFast does not practice medicine. Medical evaluation, diagnosis, treatment decisions, and prescribing decisions are made independently by licensed Providers.
In this Consent, "you" and "your" refer to the individual receiving healthcare services through the Service.
Use of Telehealth
Telehealth involves the delivery of healthcare services using electronic communications, information technology, or other means between a healthcare Provider and a patient who are not physically located in the same place.
Telehealth may be used for medical evaluation, diagnosis, treatment, follow-up care, patient education, prescription management, and other healthcare services.
Telehealth may include electronic transmission of medical records, photographs, personal health information, laboratory information, prescription information, or other data between you and your Provider. It may also include communication through secure messaging, email, telephone, video, electronic forms, patient portals, or other electronic means.
Alternative methods of care may be available to you, including in-person medical care. You may choose to seek in-person care at any time and should discuss alternative treatment options with your Provider when appropriate.
Anticipated Benefits
The use of telehealth may make it easier and more convenient for you to access medical care and treatment.
Telehealth may allow you to receive medical evaluation and care at times and locations that are more convenient for you, reduce the need for in-person appointments, communicate with Providers remotely, and receive ongoing treatment management through electronic communication.
The potential benefits of telehealth cannot be guaranteed and may vary based on your individual circumstances.
Potential Risks
While telehealth may provide benefits, there are also potential risks and limitations associated with receiving healthcare through telehealth and other technology.
These risks may include limitations on the quality, accuracy, or effectiveness of healthcare that can be provided remotely; the inability of a Provider to conduct certain physical examinations, tests, or assessments in person; and the possibility that a Provider may be unable to diagnose or treat a particular condition using telehealth.
Technology used to provide the Service may experience bugs, errors, interruptions, delays, outages, incorrect transmissions, corrupted or lost information, or other technical problems. Technology failures may interfere with your Provider's ability to evaluate or treat you.
Delays in medical evaluation or treatment may occur because of Provider availability, technical problems, or failures of electronic equipment or communications.
Electronic systems and security safeguards may fail, creating a risk of unauthorized access to or disclosure of personal or medical information.
Your Provider may not have access to all of your medical records. Incomplete or inaccurate medical information may increase the risk of adverse drug interactions, allergic reactions, inappropriate treatment, or other errors in medical judgment.
Certain laws and regulations may also limit the diagnoses, treatments, medications, or prescriptions that a Provider may provide through telehealth.
Your Provider may determine that your condition cannot be appropriately evaluated or treated through telehealth and may recommend that you seek in-person care, specialist care, laboratory testing, diagnostic testing, emergency care, or other healthcare services.
No particular outcome or result from telehealth or any treatment provided through telehealth can be guaranteed.
Emergency and Urgent Medical Situations
The Service is not intended for emergency or urgent medical care.
If you believe you are experiencing a medical emergency, call 911 or seek immediate care at an emergency room or other healthcare facility equipped to provide emergency treatment.
Providers may not respond immediately to messages or other communications submitted through the Service.
If you are not experiencing an emergency and do not require immediate or urgent care, you may communicate with your Provider using the secure communication tools available through the Service.
Data Privacy and Protection
The electronic systems used to provide the Service are designed to incorporate reasonable network, software, administrative, and technical safeguards intended to protect the privacy and security of your information.
Personal information and protected health information may be disclosed as permitted or required by applicable law, including for purposes of healthcare treatment, payment, pharmacy fulfillment, healthcare operations, administrative purposes, and other legally authorized activities.
Your Provider or Medical Group may provide a separate Notice of Privacy Practices describing how your protected health information may be used or disclosed.
Your use of the Service may include electronic communications to and from you that contain personal or medical information.
You understand that HealFast, your Providers, and other parties involved in the Service cannot guarantee the security or privacy of third-party services you use to receive communications, such as your personal email account, mobile telephone service, or devices.
HealFast's collection and use of personal information is also governed by the HealFastRx Privacy Policy.
Your Acknowledgments and Consent
By clicking "I Agree," checking a related box to signify your acceptance, using another acceptance protocol presented through the Service, or otherwise affirmatively accepting this Consent, you acknowledge and agree that:
- Healthcare services you receive from Providers through the Service will be delivered through telehealth.
- Your treating Provider may be a physician, nurse practitioner, physician assistant, or other appropriately licensed healthcare professional, and you consent to receiving care from such Providers as applicable.
- Telehealth and the technology used to provide telehealth may have limitations, errors, interruptions, delays, or other technical problems that may affect the availability, quality, accuracy, or effectiveness of the healthcare services you receive.
- The delivery of healthcare services through telehealth is an evolving area, and the technology used in your care may change over time.
- No specific benefit, outcome, weight-loss result, diagnosis, prescription, or treatment result is guaranteed.
- Your condition may not improve and, in some cases, may worsen or require additional healthcare services.
- Telehealth may not be appropriate for every medical condition or concern.
- You have the opportunity to discuss the benefits, risks, and alternatives associated with telehealth with your Provider.
- Your Provider will evaluate your medical information and, using their independent professional judgment, determine whether your condition may appropriately be evaluated or treated through telehealth.
- Your Provider may determine that your condition is not appropriate for telehealth and may recommend that you seek care from another Provider, specialist, laboratory, emergency department, or other healthcare facility.
- You understand that completing an intake, selecting a treatment option, or submitting payment does not guarantee that a prescription will be issued.
- Medical evaluation and prescribing decisions are made independently by licensed Providers. HealFast does not practice medicine or make prescribing decisions.
- You understand that there will be no intentional recording of an online medical consultation by your Provider or by you unless all necessary consent has been obtained.
- You have the right to withdraw your consent to receive future healthcare services through telehealth by providing notice to your Provider or HealFastRx.
- Withdrawal of your consent will not affect actions already taken in reliance on your prior consent.
- You understand that Providers providing services through HealFastRx may not provide in-person treatment through the Service. If you withdraw consent to telehealth, you may need to seek healthcare from another Provider.
- You understand that using the Service involves electronic communication of personal and medical information, including through secure messaging, patient portals, telephone, email, or other electronic means.
- You agree to provide HealFastRx and your Provider truthful, accurate, current, and complete information concerning your health and medical history.
- You agree to disclose information relevant to your treatment, including current medications, allergies, medical conditions, previous treatment, and care you receive from other healthcare Providers.
- You understand that failure to provide complete and accurate medical information may adversely affect your Provider's ability to safely and appropriately treat you.
- You understand and accept the potential risks associated with the use of telehealth described in this Consent.
- You voluntarily consent to receiving healthcare services through telehealth.
Prescription Fulfillment
If your Provider determines that a prescription medication is medically appropriate for you, the prescription may be sent to a licensed pharmacy partner for fulfillment.
HealFastRx may work with one or more pharmacy partners, and prescriptions may be filled or transferred between participating pharmacies where permitted by law and appropriate for fulfillment.
You may have the right to request that a prescription be sent to another pharmacy of your choice, subject to applicable law, medication availability, pharmacy capabilities, and coordination with your prescribing Provider.
Medication is prescribed by your Provider and dispensed by the applicable Pharmacy. HealFast does not prescribe or dispense prescription medication.
Financial Responsibility
Unless otherwise expressly stated, services and products provided through HealFastRx are offered on a self-pay basis.
You are responsible for amounts associated with your use of the Service, including applicable medical services, prescription medications, and other costs disclosed to you.
You should not assume that services or prescription medications obtained through HealFastRx will be covered or reimbursed by Medicare, Medicaid, another federal or state healthcare program, or a private insurance plan.
Concerns Regarding a Medical Provider
If you have concerns regarding the conduct or professional services of a licensed medical Provider, you may contact the appropriate professional licensing board or Medical Board in the state where you received care.
